1. About these terms

biotastudio.com.au (the "Site") is operated by Biota Conservation Pty Limited (ABN 13 689 381 164 ), trading as Biota Studio ("we", "us", "our"). These terms apply when you browse the Site, buy from us online or in store, or book any of our services. By placing an order or booking, you agree to them.

Our Refund & Returns Policy, Shipping Policy, Privacy Policy, Live Animal Sales & Licensing policy and any service terms that apply to your booking also form part of these terms.

2. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law, or any other law that can't be excluded. Where these terms seem to conflict with those rights, your rights prevail.

3. Who can buy from us

You must be 18 or older to place an order, or have a parent or guardian place it for you. Live reptiles and frogs can only be sold to the holder of an appropriate licence, as set out in our Live Animal Sales & Licensing policy.

4. Products and descriptions

We work hard to describe and photograph our products accurately. Live animals and plants are individuals: colour, pattern and size vary, and photos may show a representative animal rather than the one you'll receive. Sizes and ages are approximate. Natural materials such as wood, cork, rock and botanicals vary from piece to piece.

Care guides and advice on the Site are general information for keepers. They aren't veterinary advice. If your animal is unwell, see a reptile or exotics vet.

5. Prices and GST

Prices on the Site are in Australian dollars and include GST unless stated otherwise. Quotes for custom builds, leased displays and maintenance may be shown excluding GST, and will say so clearly. GST is then added to the invoice.

If a price is clearly listed in error, we'll contact you before processing the order. You can choose to pay the correct price or cancel for a full refund.

6. Orders

Your order confirmation email confirms we've received your order. We may decline or cancel an order, with a full refund, if:

  • stock is unavailable
  • a licence can't be verified
  • the sale or delivery would break the law
  • we have animal welfare concerns
  • a price or description was listed in error
  • we suspect fraud

7. Payment

Payments are processed securely by Shopify Payments and the other providers shown at checkout. We don't see or store your full card details.

8. Live animals

When you buy a live animal, you confirm that:

  • any licence information you give us is true and current
  • you're allowed to keep the species where you live
  • you'll provide appropriate housing and care

You must never release animals, plants, cultures or used substrate into the wild, gardens or waterways.

9. Delivery, ownership and risk

Delivery is covered by our Shipping Policy. Ownership of goods passes to you once we've received full payment. Responsibility for goods passes to you when they're delivered to your address or the delivery point you nominated, or when you or your nominee collect them.

10. Returns and refunds

Returns, refunds and our Live Arrival Guarantee are covered by our Refund & Returns Policy.

11. Services

The following services are covered by their own terms, together with any written quote or agreement:

  • custom enclosures
  • zoo and exhibit design
  • leased displays
  • maintenance
  • workshops

If there's a conflict, your signed quote or agreement takes priority over these terms.

12. Your account

If you create an account, keep your login details secure. Tell us straight away if you think someone else has used your account.

13. Reviews and content you share

Reviews, photos and comments you post must reflect your own genuine experience and must not be offensive, unlawful or infringe anyone else's rights. You give us permission to display the content on our Site and social media.

We may remove content that is spam, offensive or unlawful. We won't remove a genuine review just because it's negative.

14. Intellectual property

The text, photos, videos, care guides, logos and enclosure designs on the Site belong to us or our licensors. You may view and share links to them for personal use. Don't copy, republish or sell our content without our written permission.

15. Acceptable use

You must not use the Site to:

  • break the law
  • place fraudulent orders
  • upload malicious code
  • scrape or copy content in bulk
  • interfere with how the Site works

16. Third-party sites and services

The Site may link to, or use, third-party websites and apps, such as payment, shipping, review and booking tools. We aren't responsible for their content or practices. Their own terms apply when you use them.

17. Site availability

We aim to keep the Site accurate and available, but we may update content, change products or take the Site offline for maintenance at any time.

18. Limitation of liability

To the extent the law allows, and subject to the Australian Consumer Law, we aren't liable for indirect or consequential loss arising from your use of the Site or our products.

Where goods or services aren't of a kind ordinarily acquired for personal, domestic or household use, our liability for failing to meet a consumer guarantee is limited, where the law allows, to:

  • for goods: replacing or repairing them, or paying the cost of doing so
  • for services: supplying them again, or paying the cost of doing so

We aren't responsible for loss to the extent it's caused by not following the care or installation instructions we gave you.

19. Your responsibility

You're responsible for loss we suffer because you:

  • give us false licence or identity information
  • place a fraudulent order
  • use our products or Site in breach of the law

20. Privacy

We handle your personal information in line with our Privacy Policy.

21. Changes to these terms

We may update these terms from time to time. Changes apply to orders and bookings made after the updated terms are published. The date at the top shows the latest version.

22. General

If any part of these terms is found to be unenforceable, the rest still applies. If we don't enforce a term straight away, we haven't given up the right to enforce it later.

23. Governing law

These terms are governed by the laws of New South Wales, Australia. Disputes are heard in the courts of New South Wales.
